Terms of Use

These Terms of Use (“Terms”) govern access to and use of the applications, APIs, platforms, and services provided by Fantaclaus Technologies Private Limited, operating under the trade name InteligenAI (“InteligenAI”, “we”, “our”, or “us”).
By accessing or using the Service, including creating an account or configuring API access, you agree to be bound by these Terms.

1. Disclaimer and role of InteligenAI

InteligenAI is an independent technology provider that offers technical integration services for the WhatsApp Business Platform API, a product provided by Meta Platforms, Inc.
  • Does not operate, control, or provide the WhatsApp application or messaging network
  • Is not owned, operated, sponsored, or endorsed by Meta Platforms, Inc. or WhatsApp
  • Does not determine message recipients, message content, or consent status
WhatsApp is a trademark of Meta Platforms, Inc., and all rights related to the WhatsApp Business Platform API remain with Meta.

2. Acceptance of Terms

By registering for, accessing, or using the Service, you:
  • Acknowledge that you have read and understood these Terms
  • Agree to comply with these Terms and all applicable laws and regulations
  • Agree to comply with all applicable WhatsApp Business Platform Terms, Policies, and Guidelines
These Terms form a legally binding agreement between you and InteligenAI.

3. Eligibility

You represent and warrant that:
  • You are at least 18 years of age; and
  • You have the authority to bind the business or entity on whose behalf you are using the Service.
The Service is intended only for business use. The Service is not intended for personal, household, or consumer use.

4. Description of the service

InteligenAI provides software and API-based tools that enable businesses to:
  • Integrate with the WhatsApp Business Platform API
  • Programmatically send and receive WhatsApp messages
  • Manage messaging workflows, automation, and technical configurations
InteligenAI provides technical infrastructure only and does not engage with end users directly.

5. Account registration and security

To use the Service, you may be required to create an account.
You agree to:
  • Provide accurate and complete information
  • Keep your login credentials secure
  • Be responsible for all activity conducted through your account
InteligenAI is not responsible for unauthorized access resulting from your failure to safeguard credentials.

6. Client responsibilities

You are solely responsible for:
  • Ensuring that all WhatsApp communications comply with applicable laws and regulations
  • Obtaining valid consent from end users for WhatsApp messaging
  • Providing appropriate privacy notices to end users
  • Ensuring message content complies with WhatsApp and Meta policies
InteligenAI does not validate consent, review message content, or control message delivery decisions.

7. Acceptable use

You agree not to use the Service to:
  • Send spam, unsolicited, or illegal messages
  • Engage in fraud, harassment, abuse, or deceptive practices
  • Violate any applicable law, regulation, or third-party policy
  • Circumvent WhatsApp Business Platform safeguards
Violation of these requirements may result in suspension or termination of access.

8. Data processing and privacy

InteligenAI processes data strictly in accordance with its Privacy Policy, which forms an integral part of these Terms. Clients remain the data controllers for all end-user data.
InteligenAI acts only as a data processor. Message content is processed solely to deliver the Service. InteligenAI does not sell personal data and does not use message content for advertising or profiling.

9. Intellectual property

All rights, title, and interest in the Service, including software, APIs, documentation, and infrastructure, are owned by InteligenAI or its licensors. You are granted a limited, non-exclusive, non-transferable right to use the Service solely for your internal business purposes.

10. Third-party services

The Service integrates with third-party platforms, including Meta Platforms, Inc.
InteligenAI is not responsible for:
  • Availability or functionality of third-party services
  • Changes to WhatsApp or Meta policies
  • Actions taken by Meta, including account suspension or limitation

11. Service availability

The Service is provided on an “as-is” and “as-available” basis. InteligenAI does not guarantee message delivery, which depends on Meta and WhatsApp systems. InteligenAI does not guarantee uninterrupted or error-free operation and may modify, suspend, or discontinue the Service at any time.

12. Limitation of liability

To the maximum extent permitted by law, InteligenAI shall not be liable for:
  • Indirect, incidental, or consequential damages
  • Loss of data, revenue, or business
  • Actions taken by Meta or WhatsApp
Total liability, if any, shall not exceed the fees paid by you to InteligenAI for the Service in the preceding 12 months.

13. Indemnification

You agree to indemnify and hold harmless InteligenAI from any claims, damages, or liabilities arising from:
  • Your use of the Service
  • Your message content
  • Your violation of laws or third-party policies

14. Suspension and termination

InteligenAI may suspend or terminate access if:
  • These Terms are violated
  • Required by law or Meta policy
  • Continued use poses a risk to the platform or third parties
Upon termination, your right to use the Service ceases immediately.

15. Changes to these terms

InteligenAI may update or modify these Terms of Use at any time. Changes take effect immediately upon posting on our website. Continued use of the services indicates acceptance of the revised Terms.

16. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts located in India shall have exclusive jurisdiction.
